You represent and warrant that:

  • You are not listed on any U.S. Government list of prohibited or restricted parties.

11. Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to accomplish its intended purpose to the greatest extent possible under applicable law, and the remaining provisions will remain in full force and effect.

Waiver

The failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. No waiver of any breach shall be deemed a waiver of any subsequent breach.

12. Translation Interpretation

These Terms may have been translated if We have made them available to You in a language other than English. In case of a dispute, the original English version shall prevail.

13. Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a change is material, We will try to provide at least 30 days’ notice before the new terms take effect. What constitutes a material change will be determined at Our sole discretion.
